THE STRATEGY OF CRIMINOLOGICAL SAFETY IN KAZAKHSTAN: THEORY, LEGISLATION AND PRACTICE OF PROVIDING

Abstract:
Article is devoted to the comparative analysis of strategy of safety as private criminological theory, independent branch of the legislation and practice of their providing. Authors note that the modern paradigm of counteraction of crime is based on the main categories of the theory of crime prevention. At the same time the latest researches show withdrawal from the narrow "branch" approach determining safety from criminal threats only by forces of law-enforcement structures. Selecting the theory of criminological safety as the private theory of criminology, authors connect its specifics and the importance with features of the purpose, object and subject of studying, and also carry out differentiation of components of this concept. Authors analysed system of the operating "right of safety". Officially fixed concepts of safety, threats to security, objects of safety, types of safety are considered. In confirmation of the thesis that the central place among legal guarantees of ensuring strategy of safety is allocated to the criminal law, short stories of the existing Criminal Code of Kazakhstan of 2014 are noted. The conducted research allowed to reveal features of ensuring public and personal (sexual) security at the present stage of development of the Kazakhstan society, and also to determine the content of strategy of criminological safety.
